<title>Davis Blvd Median - E-Mail to Comissioners</title>

<description>Dear County Commissioners.   Thank you for hearing the pleas of  the school, church, and residential communities along Davis Blvd.  We  noted in the State Transportation Department presentation that there would be  major costs and time delays in curbing and landscaping the small section of  Davis  Blvd between the Falling Waters/Countryside entrance  and County Barn  Road for several reasons, which were as  follows:DOT stated that they would require  the road to be regraded to cause the rainwater runoff to go to the outside of  the roadway instead of the center median.  However, the attached photo  (IMG_0936_1), taken today, indicates that water o­n the left lanes of the roadway  already flow toward the outside edge of the road, not toward the center median.   Thus, DOT was wrong in their  statement.DOT also stated that they would most  likely require an alternative water retention area to that now in the existing  center median and that they at least would have to tear up the roadway to  provide the necessary drains.However, the attached photos  (IMG_0939_1 and IMG_0940_1) show a water collection drain and a storm sewer pipe  that allows water from the median not to collect in the median, but instead to  flow directly under the westbound lanes into the existing canal o­n the north  side of Davis  Blvd.  There are two such drains o­n this section of  roadway.  Again,  the DOT was wrong in their  statement.Also, photo IMG_0938_1 shows there  are already &quot;drive over&quot; curbs in that section of the roadway  between roadway wherever there is a left turn lane or  crossover.Also, DOT indicated that the center  median in question was too narrow to provide landscaping.  It should be noted  that the median in that section of the roadway is just as wide as the median  already landscaped o­n the west side of County Barn.  And, the median o­n the West of  Country Barn to Heritage  Way, does not have streetside gutters.  This  median is at the same level as the neglected roadway of SR 84 has a curbed  landscaped median with no evidence of roadway flooding in 14  years!Also, DOT indicated that the  existing street lighting and sidewalk o­n the south side of Davis ended at Heritage  Trail, when in fact the street lighting goes at least 100 yards further east to  Florida Club  Circle, and the existing sidewalk extends all the way  to County Barn  Road! It appears that FDOT presented a  overly pessimistic, worst case scenario not based o­n fact.  And  that they should be asked to come up with more realistic time and cost to do the  job.  Also, because they apparently are refusing to modify their existing  request for proposal for the portion of the Davis Blvd east of Santa Barbara,  and instead are saying that a whole new contract is needed, even though the  supplies and equipment would be available as part of that effort, they might be  in danger of being charged with waste and abuse of taxpayer funds.  It just  looks to me like they just don&amp;#39;t want to put out the effort to expedite the work  that both the County Commissioners and the citizens of the area  are judiciously requesting.I respectively request that this  situation be pursued at the State level.  And that corrective action be  taken. Additonally, respectively  request you to ask FDOT to present a 4th option for roadway improvement o&amp;shy;n SR  -84, from the entrances Countryside/Fall Waters communities to County Bar  Road.  Respectively, the 4th option should state costs for median curbing o&amp;shy;nly,  median non-potable water connection, street lights, and a sidewalk (only) o&amp;shy;n the  Southside of SR-84. </description>

As you are aware, it was o­nce a two lane very  dangerousroad with no lights from Airport to  Santa Barbara.     In 17 years the area has grown with many developments built o­n both sides of  the road which has beenwidened over the years, lights  installed &amp; the median beautifully landscaped from 5th Ave.  to County Barn  Rd.From  County Barn Rd. to Santa  Barbara Blvd, which is a small strip of median,  it seemed everything stopped  and has remained that way  for years.  The question is why???  No  landscaping and no lights.There are two other major resident  developments in this area besides Falling Waters which are , Glen Eagle, &amp;  Countryside.  In addition toTeresina Grand,   Unity  Church &amp; Seacrest School.  This is not a barren area that  should have been neglected.The excuse we have heard for years  was the fact that this was a state road and not a county road or it would have  been completed, however why was only part of this state road  landscaped and then abruptly ended at County Barn Rd.  This is a question many  people have asked including people just visitingwhich is very noticeable when  traveling Davis Blvd. in either direction.  It doesn’t seem logical not to  complete this median to Santa  Barbara Blvd.  The landscaping o­n the roads and in  the medians all over Naples are sometimes breathtaking with the  colors of the trees and plants, which many peoplehave commented about, however at our  end of Davis we  view either  weeds, tall grass or garbage thrown from cars whenever we leave our  beautifully landscaped facility.  This does not seem right for  residents who are paying the same taxes as other residents that have a nice view  of the  landscaped medians when leaving their facility. <description>The 2011 / 2012 Bocce league concluded Monday March 24, 2011.  As usual,  it was a great success and fun for all.  A pizza party was held in the clubhouse and awards were then presented to the winners.   The Fall league consisted of 40 actively  involved players. This years spring tournament champion team consisted of : Ann MacIntyre, Mary Jensen, John Elsey and Tom Morin while second place went to: Sal Tuminello, Ivan Pervan, Maureen Skonie and Jackie Voss.     The winter session had 72 players participating  making it the largest activity in Falling Waters. 2012 / 2013 season appears to be even more popular.  Sign-up info will be available in the fall. Thanks to ALL that participated and have a pleasant summer. </description>

<title>Davis Blvd Update</title>

<description>Falling Waters, together with neighboring communities, has been active in participating in the Davis Blvd. enhancement program.  The following report was prepared by a representative from Countryside.The subject meeting held at the BCC meeting room included all the County Commissioners, Naples City council reps, Florida DOT, MPO reps, Collier DOT reps. My public comment was the o&amp;shy;nly o&amp;shy;ne to address Davis Blvd, SR 84. My request was for the current contract for SR 84 from Santa Barbara Blvd Eastward to Radio Road, in its design phase scheduled for submission to the State in June, be amended to include SR 84 Westward from Santa Barbara Blvd to County Barn. My comments were well received by the County Commissioners. Commissioner Coyle supported the amendment and also asked for landscaping (which I had not included in my comments), Also supporting this effort were Commissioners Fiala, Henning, and Hiller. However, the Florida DOT, does not want to include the amendment in the current design package. The Florida DOT rep. did state that this section does qualify for street lights and sidewalks are already funded, but he was not in favor of curbing. His reasoning was providing curbing would include addressing drainage issues and needed a great deal of planning. The Commissioners insisted, the SR 84 improvements from Westward to County Barn be put o&amp;shy;n the next 2 meeting agendas. Unfortunately the next MPO meeting, scheduled for April 13th, is to be held in Immoklee and the emphasis will be o&amp;shy;n Immokalee. I understand that SR 84 will be o&amp;shy;n the agenda, but the May MPO meeting will deal more in depth with SR 84. The Commissioners indicated the May meeting at the BCC meeting room would need room for all the interested citizens. I will let you know of the date and time for the May meeting. I would hope you will plan to attend and bring several of your members with you. Improvements o&amp;shy;n SR 84 from Santa Barbara Blvd to County Barn will be paid by State funds with some funding from Collier County. To accomplish this task, it needs support from Falling Water, Unity Church, Seacrest County Day school, and Terracina Grand.Currently four of the Collier County Commissioners support  improvements o&amp;shy;n the 2/3 mile segment of SR 84, Davis Blvd. and they are  Commissioners Coyle, Henning, Fiala, and Hiller.  At present, the Florida  DOT is saying they are preparing to put in sidewalks (not sure if this is o&amp;shy;n  both sides of the roadway) and street lights. I believe the Commissioners  will be trying to have FDOT include curbing (which would include addressing the  drainage issues) and perhaps landscaping.  It is important that all  interested parties with frontage o&amp;shy;n this 2/3 mile stretch of Davis  Blvd. show support for Davis Blvd. improvements, especially at  the upcoming May meeting.  I would encourage those who attend, sign up  to speak at the open forum.  Those who plan to attend the meetings,  should arrive 15 minutes prior to the scheduled meeting.  Public speaking  forms should be available o&amp;shy;n the table outside of the meeting room.  If you  decide not to speak after filling out a form, that is easily  accomplished by stating your concerns have been adequately  covered. _________________________________________MPO Meeting dates:

      FOR IMMEDIATE RELEASE
    Collier County Commissioners today passed a Resolution asking the State Legislature to grant relief to condominium owners who are faced with very expensive retrofits to conform to a national fire/safety code.
    Unlike other states that implemented this code, the State of Florida made the code retroactive. This exposes condo owners to thousands of dollars for costs of retrofitting. In some cases it will be impossible for the owners to make the changes without major reconstruction.
    &amp;quot;We frequently make changes to building and land development codes,&amp;quot; County Commissioner Fred Coyle said, referring to actions by local government. &amp;quot;But we don’t make them retroactive. If we did that the County would be in chaos.&amp;quot;
    Coyle emphasized that property owners already have enough to worry about. Bill Poteet, representing the Naples Area Board of Realtors (NABOR), echoed Coyle’s concerns by citing the effects on the real estate market. &amp;quot;This legislation will not only cost owners a lot of money, it will drive property values down and interfere with the recovery of the market.&amp;quot;
    The Resolution introduced by Coyle is supported by local condo owner Ewing Sutherland of the Community Advocacy Network (CAN) which represents thousands of condo owners throughout Florida. The proposed solution is to allow condo owners a degree of self-determination by permitting them to reject the retrofitting upon majority vote.

Dwight Brock, Clerk of the 
Circuit Court of Collier County, issued a notice to the citizens of Collier 
County informing them that residents are receiving letters from a private 
company offering to provide them with a certified copy of their property 
deed for $59.50 which includes location, retrieval, postage and handling. The 
company, Florida Record Retrieval, Inc. in Plantation, FL offers this service by 
mail, fax or internet at www.floridadeedservice.com.

The Clerk wants citizens to 
know that they can obtain a certified copy of their property deed through 
the Clerk’s Recording Department for $1.00/ page plus a $2.00 charge for 
document certification, plus any mailing costs.

During these difficult economic 
times, Dwight stated he “does not want the public to be taken advantage of and 
unless someone has a 50 page deed, it does not make good economic sense, as most 
deeds are just one or two 
pages in length.” 


Citizens can get a certified 
copy of their property deed by visiting the Clerk’s Recording Department on the 
2nd Floor of the Courthouse Annex at Government Center Complex or 
from any full service satellite office if the deed was recorded after

  A new bike rack will shortly be installed at the clubhouse with spaces for 12 bikes. The rack at the Gate entry area&amp;nbsp;will have spaces for 6 bikes when istalled.&amp;nbsp;It is suggested that the bikes be locked to prevent loss as this will not be the responsiblity of Falling Waters Master Association.

<title>Tennis Court Notice</title>

    NOTICE 
    Damage to the Tennis Court Gate and poles at Court #2 Sunday night someone broke the gate to court #2 and played tennis on a surface that was under repair and hadn't been planned to be opened until the sprinklers watered them during the night with final surface preparation Monday. The gates were locked for this very reason and for those who broke in for their pleasure caused much damage to the gate and fence and additional repairs to the Court.
    This is one of our assets that U.S. Tennis has called one of the best facilities in our area.
    We must now call U.S. Tennis to make repairs so the Proximity Card Readers may be installed. The poles are bent and two of the support bars were separated so they must be straightened or replaced.
    Our best security is each other and we must be alert to protect these assets.
